Notice of Intent to Sole Source NINJA SUSTAINMENT

The Ninja system is a proprietary item and requires proprietary parts and services. Black River Systems Company, Inc. was the Prime Contractor for FA8750-19-C-0040 (OCOSA Contract), a Phase III SBIR award from Air Force Research Laboratory (AFRL/RIGB). The Ninja product suite was developed under the OCOSA contract with some initial engineering having been completed under predecessor SBIR Phases I and II contracts. Black River Systems Company was the Prime Contractor on the SBIR I and Phase II contract as well.

Black River Systems Company has asserted its SBIR data rights, under these contracts and as defined in DFARS 252.227-7018, “Rights in Noncommercial Technical Data and Computer Software—Small Business Innovation Research (SBIR) Program”. Black River Systems hereby submits that it has all ownership rights to the Ninja products that are being offered. Black River does not re-sell parts to third parties. All parts and knowledge protected by SIBR.
