Cell Phone Services for the U.S. Embassy Kyiv

NOTICE OF INTENT TO SOLE SOURCE This notice is being published in accordance with Federal Acquisition Regulation (FAR) Subpart 5.101 requiring dissemination of information for proposed contract actions. This is a notice of intent to award a sole source Indefinite Delivery Indefinite Quantity (IDIQ) contract and is not a request for competitive quotes/proposals. The statutory authority for this sole source procurement is prescribed by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.

Background: To support operational mobile communication needs, the U.S. Embassy Kyiv is required to obtain mobile telephone and Internet services that include calls within Ukraine, international calls, international roaming, mobile Internet, SMS messaging, voicemail services, VoLTE and VoWiFi connectivity, eSIM codes generation. The only one source is reasonably available based on compelling need.

Although phone number portability is available, the U.S. Embassy Kyiv cannot risk loss of current phone numbers in a war time environment. Any disruption to cellular service, phone number continuity, or other unanticipated events related to number portability are an unacceptable risk to the safety and security risks of all mission personnel.

The Embassy of the United States of America in Kyiv, Ukraine, intends to issue an IDIQ contract for a base and one option year with a fixed unit price as a sole source award to Lifecell LLC on or about July 1, 2024. The ordering period will be twelve (12) months with anticipated maximum total contract value of USD 190,000 in which the funding will be obligated at the task order level. The North American Industry Classification System (NAICS) code for this requirement is:

517112 - Wireless Telecommunications Carriers (except Satellite). This notice is not a request for proposals or quote. However, all responsible sources may submit a capability statement demonstrating the ability to provide the requested services, which shall be considered by the agency before the intended award date. Interested sources who submit data are responsible for appropriately marking information if it is proprietary in nature.

The Government shall not reimburse interested sources for any information provided. No requests for capability briefings will be honored. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Interested vendors must respond to this notice on or before June 21, 2024, at 17:00 local (Kyiv) time by sending an email to KyivSoicitations@state.gov.
