This is a Sole Source, Labor Hour Request for Quotation (RFQ), No. FR24RCC30000000003, being issued by the Federal Railroad Administration (FRA) Office of Acquisition to support the Outside Counsel Bright Line West project.
The Sole Source is supported by the FAR Part 6.302-2, Unusual and Compelling Urgency to mitigate risk and to provide adequate time to compete a larger vehicle for ongoing services; otherwise, FRA would be at risk of serious financial injury if its ability to obtain the counsel expertise was delayed.
The FRA is seeking legal services in connection with its administration of grant funding with respect to the Brightline West Project sponsored by the San Bernadino County Transportation Authority (SBCTA) and Nevada Department of Transportation (NDOT) and its project partner DesertXpress Enterprises, LLC, a Nevada limited liability company, d/b/a “Brightline West.” The project was selected for funding under the Federal State Partnership for Intercity Passenger Rail (FSP Program) codified at 49 U.S.C. § 24911 and the Rebuilding American Infrastructure with Sustainability and Equity (RAISE) Program was revised and reauthorized in the Infrastructure Investment and Jobs Act (IIJA) (Pub.
L. 117-58). This OPEN-MARKET solicitation is prepared in accordance with FAR Part 12, the acquisition of commercial items in conjunction with the policies and procedures for solicitation, evaluation, and award as prescribed in FAR 13, Simplified Acquisition Procedures. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2024-04.
This solicitation is an UNRESTRICTED and the North American Industry Classification System (NAICS) code is 541110 with an industry size standard of $15.5 million. A responsible quoter is one whose offer conforms to the solicitation and will be most advantageous to the Government.
