Notice of Intent: Falcon Scanner Maintenance

The IRS Office of Information Technology Acquisition (OITA); TIER 2/3 Branch, intends to negotiate a sole-source acquisition in accordance with FAR 13.106-1(b) SOLE SOURCE JUSTIFICATION FOR ACQUISITIONS AT OR BELOW THE SIMPLIFIED ACQUISITION THRESHOLD with OPEX Corporation. This acquisition is to renew the maintenance/technical support of four OPEX Falcon highspeed scanners. The Falcon scanners process seized financial documents to use as evidence in support of financial crimes cases and projects.

The annual maintenance is critical to protect investment and must be renewed to ensure that the scanners remain operational and reliable. There are no re-sellers authorized to perform maintenance on OPEX equipment. The period of performance will be one 12-month period from the date of contract award. No solicitation package will be issued. All responsible sources may submit a bid, proposal, or quotation which shall be considered by the agency.

This notice of intent to sole source is not a request for competitive quotations; however, the Government will consider responses received no later than noon, EST on January 11, 2023. Responses shall be submitted to JW Terry @ jw.r.terry@irs.gov. Responses shall include, at a minimum, the following information:

1. The name of your company;

2. Company SAM Unique Entity ID (UEI) Number and CAGE Code;

3. Point of Contact, and secondary contact, information;

4. The specific service(s) that your company offers that fulfills the same function as the items to be included on this order or evidence that your company is capable of providing the specific items mentioned above; and, 5. A description of that service(s) and its overall capabilities. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government's Contracting Officer. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
