This is a Notice of Intent published in accordance with Federal Acquisition Regulation (FAR) 5.101(a)(1) requiring the dissemination of information regarding proposed contract actions. This Notice of Intent is for a proposed award of a sole source, firm-fixed price contract under the authority of 41 U.S.C. 3304(a)(1), as implemented by FAR 13.106-1(b) - Only One Responsible Source and No Other Supplies or Service Will Satisfy Agency Requirements.

It is NOT a request for competitive offers, proposals, quotes, or capability statements. The Department of Veterans Affairs, Network Contracting Office 02, on behalf of the East Orange VA Medical Center (VAMC), intends to award a sole source, firm-fixed price contract to Emergency Water Solutions LLC (also dba as First Water Inc.) for the emergency procurement of a First Water HCF-1 Configuration water filtration system to replace their current system manufactured by Emergency Water Solutions that s end of life.

The system will provide filtered, potable water for critical activities such as drinking, food preparation, dialysis, bathing, and general medical support during emergencies. The using service reviewed several water filtration systems but only the HCF-1 system from First Water had the required certifications and met the VA Healthcare performance and safety standards. Emergency Water Solutions is the original equipment manufacturer (OEM) and sole distributor of this equipment.

The North American Industry Classification System (NAICS) code for this requirement is 221310 Water Supply and Irrigation Systems. The Product Service Code is 4610 Water Purification Equipment. While this synopsis DOES NOT constitute a solicitation, interested vendors may identify their interest and capability to satisfy the requirement. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency.

The Government understands that Emergency Water Solutions, LLC, is the only vendor that can provide the required HCF-1 water filtration system.

However, vendors that believe they can provide the capabilities required to fully meet the Government's requirement may submit information in writing to Jonathan Kilgore, Contracting Officer at jonathan.kilgore@va.gov no later than 10:00 AM EST on July 28, 2025. Such documentation will be reviewed solely for the purpose of determining whether to conduct the procurement on a competitive basis. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.
