JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
1. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.
The Veterans Heath Administration, Department of Veterans Affairs (VA) currently leases 13,595 ABOA/14,411 Rentable Square Feet (RSF) of medical space at 3000 Lincoln Drive East, Marlton, NJ 08053 under lease number VA244-14-L-0094 for the Burlington Clinic. The current lease expired on March 3, 2026. Approval is requested to negotiate a succeeding lease with the incumbent Lessor without full and open competition for continued occupancy at this leased location. The procedures for pursuing a succeeding lease are detailed in GSAR 570.402: Succeeding Leases.
2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS (INCLUDING ESTIMATED VALUE).
VA submitted a continuing need letter on August 12, 2025, for 14,411 rentable square feet of clinical and related space. To satisfy the VA mission requirements the facility must be within a walkable distance of 3000 Lincoln Drive East, Marlton, NJ.
This requirement is for 13,595 ABOA/14,411 RSF of space for a 15-year term to commence on March 4, 2026.
The delineated area is:
Northern: County Road 537
Southern: Route 70
Eastern: Pine Street/Eayrestown Rd.
Western: Route 73
There is no federal space available.
3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION.
41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. This statutory authority is implemented through FAR 6.103-1 (GSA Class Deviation RFO-

2025-06) and GSAR 570.402: Succeeding Leases. In accordance with GSAR 570.402, use of the sole source authority is appropriate where the lease contracting officer does not identify any potential acceptable locations through advertisement and market research, or it is determined that award to any other offeror would result in substantial duplication of costs to the Government that are not expected to be recovered through competition.
4. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.
The VA Lease Contracting Officer did not identify any potential acceptable locations through the advertisement or survey of the market. Section 5 and 7 of this justification describe efforts to locate alternative sources. Therefore, in accordance with GSAR 570.402-4: No Potential Acceptable Locations, a cost benefit analysis is not required for this justification.
5. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE.
Per the requirements of GSAR 570.402, the VA Lease Contracting Officer placed a sources sought/succeeding lease advertisement on the Contracting Opportunities domain of SAM.gov on June 16, 2026, for three days. In addition, market research was conducted using CoStar.
7. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS.
On June 16, 2026, market research was conducted using CoStar and one (1) potentially acceptable location was identified, including the incumbent, that might meet the agency’s needs within the delineated area. In addition, the VA Lease Contracting Officer posted an advertisement conforming to GSAR 570.402-2 on the Contract Opportunities domain of SAM.gov website on June 16, 2026.

8. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION.
The current Lessor has demonstrated consistently strong and reliable performance throughout the term of the existing lease. All required services, including facility maintenance, building operations, security, custodial services, and timely response to service calls, have been performed in accordance with lease requirements. The Lessor has maintained an excellent record of responsiveness to government needs and has resolved any issues promptly and professionally.
The building remains in good overall condition, with systems and structural components performing satisfactorily and without deficiencies that would impact mission operations. The Lessor has ensured that the space continues to meet all operational, safety, and accessibility requirements, supporting uninterrupted agency performance.
Given the Government’s satisfactory experience with the current Lessor, the continued suitability of the space, and the lack of any performance issues, Lessor’s past performance supports proceeding with a succeeding lease under other than full and open competition.
9. LIST OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITION.
The incumbent only.
10. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION.
There are no systemic barriers to competition. If the agency has a continuing need for space upon lease expiration, VA will follow all authorities, regulations and policies applicable to lease acquisition. Should there be remaining useful life in the Government’s tenant improvements, the Government will consider the cost of moving from the existing location, and the cost to build out new space when deciding whether to undergo a competitive action.
Additionally, objective scrutiny will be given to the customer agency’s mission and security requirements, (if applicable), to eliminate unnecessary agency space requirements that may be deemed unduly restrictive.
