Notice of Intent to Sole Source-FLOW-3D Software

The U.S. Geological Survey (USGS) intends to award a sole source contract for FLOW 3D HYDRO a computational fluid dynamics (CFD) software. This notice is issued in accordance with Revolutionary FAR Overhaul (RFO) 12.102(a), which specifies that Part 12 acquisition procedures apply to commercial products and services and shall take precedence where inconsistencies exist with other FAR parts.

The USGS Eastern Ecological Science Center relies on FLOW 3D HYDRO¿a computational fluid dynamics (CFD) software¿to support ongoing and future hydraulic engineering and fish passage research. Continuity of maintenance and technical support is required to ensure uninterrupted access to software updates, corrections, and assistance, enabling timely capture, processing, and dissemination of scientific data.

The current maintenance contract expires September 30, 2026, and renewal is necessary to sustain operational capability and mission objectives. Flow Science, Inc. is the exclusive provider and licensor for FLOW-3D software and maintenance. They maintain sole proprietary rights to the creation, development, distribution, and maintenance for this software, and there are no other authorized distributors available. There are no resellers in the marketplace.

This procurement is being conducted under commercial acquisition procedures per RFO 12.102(a), as the services required meet the definition of commercial services under FAR 2.101. The NAICS code is 513210 Software Publishers. The size standard is $47.0.

Period of Performance: One year with three option periods.
