Request for Proposal (RFP)

This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with (IAW) the format in Federal Acquisition Regulation (FAR) Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested, and a written solicitation will not be issued.

This solicitation is a Request for Proposal (RFP). This action is posted as a 100% Small Business Set-Aside under NAICS Code: 333310 Commercial and Service Industry Machinery Manufacturing. The size standard for the NAICS Code is 1000 employees.  The Federal Supply Classification (Product Service Code, PSC)  is 1240, Optical Sighting And Ranging Equipment.

In accordance with (IAW) FAR 19.0001, Concern means any business entity organized for profit (even if its ownership is in the hands of a nonprofit entity) with a place of business located in the United States or its outlying areas and that makes a significant contribution to the U.S. economy.

The U.S. Army Contracting Command-Aberdeen Proving Ground (ACC-APG), an agency of the Government, has a requirement for the procurement of Thermal Imaging Devices.  This procurement is a country directed requirement for Foreign Military Sales (FMS) Case AL-B-UBX, for the country of Albania. The Government anticipates the issuance of a commercial Firm Fixed Price (FFP) contract as a result of subject synopsis/solicitation. The anticipated date of award is to be determined; but no later than 15 October 2026.

All supplies/services are requested to be proposed upon and specified by the offeror as seen below:

  3. Sensor Pixel Pitch:  Not more than 12 micrometers
  4. Battery Operating Life:  Not less than 1 ½ hours, Not less than 4 hours rechargeable
  5. Environmental:  Satisfies MILSTD 810G
  6. Weight: Not more than 600 grams

CLIN 0003: Binocular Video Recorder, Day/Night with GPS and removable memory/USB media output port:

  1. Detection Range:  Not less than 1800 meters
  2. Thermal Resolution:  Not less than 640 X 512 pixels
  3. Thermal Sensor Pixel Pitch:  Not more than 12 micrometers
  4. Display Resolution:  not less than 1920 X 1080 pixels
  5. Laser Type:  Eyesafe
  6. Laser Accuracy:  One (1) meter at 1000-meter distance
  7. Memory:  Not less than 64 GB removeable SD card and/or 64 GB internal memory capable of being exported using USB (A or C) port
  8. Environmental:  IP67 Waterproof
  9. Battery Life:  Not less than 8 hours

Other Information/Requirements:

  1. It is the responsibility of the Offeror to ensure that their Offer is compliant with ALL provisions of the FAR and its supplements.  The Government MAY, but is not obligated to, consider an Offer that is non-compliant with any provision of the FAR and its supplements.  Furthermore, the Government is NOT required to inform any Offeror that their Offer is non-compliant with the FAR or any of its supplements.  Failure of an Offer to comply with any provision of the FAR and its supplements may result in the Offeror being deemed non-responsive to the solicitation.
     
  2. The Government’s Details of Delivery Location and Inspection and Acceptance are as follows:

  • VENDORS SHALL NOT SHIP MATERIAL or include any delivery charge
  • Vendor will submit Transportation Shipping Instructions Request (SIR) to DCMA for subsequent shipment instructions.  The DCMA office requires 15 days notification prior to actual shipment pickup.  Cognizant DCMA will be provided at time of award.
  • No partial shipments, CLINs must be shipped in entirety
  • Vendor will comply with required commercial packaging standards: MIL-STD-129P, ISPM 15 and ASTM D 3951-18 along with military standards described within the Statement of Work.
  1. All responsible sources may submit a quote which will be considered by the Contracting Officer. The offeror must be registered in the System for Award Management (SAM) database and include the assigned Unique Entity Identification code 9UEID)  with quote submission.  Failure to Offeror to provide required SAM issued UEID will result in inedibility of award.
  2. **Offerors SHALL include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, with their response.  Additionally, Offerors shall provide a completed copy of 52.204-24 and 52.204-26 with their response.** Failure of Offeror to provide required completed provisions will result in ineligibility of award.
  3. **Offerors SHALL include a copy of Original Equipment Manufacturer (OEM) specification sheets for all offered products.** Failure of Offeror to provide specification sheets for offered products will result in ineligibility of award.
  4. CMMC Level 2 (Self) or higher,  is required at time of proposal submission. **Offerors SHALL include a copy of current CMMC certification**. Failure of Offeror to provide CMMC certification with UID will result in ineligibility of award.

BASIS FOR AWARD:

Proposals will be evaluated in accordance with FAR 12.203, Evaluation. A single award will be made based on the Lowest Priced Technically Acceptable (LPTA) evaluation approach. (Note: See FAR 52.212-2 for evaluation criteria detailed herein). The Government intends to award a contract resulting from this solicitation to the responsible Offeror whose proposal represents the best value after evaluation.  Offerors shall comply with security requirements as detailed within the Statement of Work.

In accordance with FAR 52.215-1(f)(4), the Government intends to evaluate proposals and award without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offerors initial proposal should contain the offerors best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

The Government reserves the right to ONLY evaluate the LOWEST PRICED OFFEROR for technical capability. Should the lowest price offeror be determined as unacceptable, the next lowest offeror will be evaluated for technical capability, and so forth. 

Proposals will be evaluated in accordance with FAR 52.212-2, “Evaluation—Commercial Products and Commercial Services (Nov 2021)” in accordance with (IAW) FAR 12.203:

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforms to the solicitation and will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Factor 1 Cost/Price: Price will be evaluated based on the total proposed price for CLIN 0001, 0002 and 0003.

Factor 2 Technical: Technical will be evaluated based on the technical capability of the item(s) offered to meet the Government’s requirement.  Additionally, the technical element of the evaluation shall be based solely on information furnished by the vendor. The Government is not responsible for locating or securing any information which is not provided in the proposal.

Factor 3 Past Performance: This may include reviewing performance information reported to the Contractor Performance Assessment Reporting System, as well as other sources of information.

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
