Notice of Intent to Award Sole Source Procurement for NALEMP Support

NOTICE OF INTENT TO AWARD SOLE SOURCE PROCUREMENT: Under the authority of FAR 13.106-1(b)(1)(i), Purchases not exceeding the simplified acquisition threshold and only one source reasonably available, it is the Government's intent to award a new contract for Technical Support, Field Level Support, and Logistical Support as part of Native American Lands Environmental Mitigation Program.

A determination by the Government not to compete this proposed requirement is based upon the fact that Sundance Consulting, LLC, the current contractor, has been working NALEMP for nearly 20 years with commendable results. Sundance has extensive knowledge of the NALEMP program and processes and has been cultivating comprehensive expertise and building strong relationships with participating pueblos and tribes.

This unique knowledge built on decades on experience specific to NALEMP is extremely beneficial to managing the complexity of the program. Comparatively, bringing an alternative contractor up to speed with processes, information, and building relationships would be more costly than leveraging Sundance’s current knowledge and experience with the program.

Due to the complexity of the NALEMP program, USACE would be unable to commission another company and be consistent and timely in addressing appropriate program needs. Therefore, Sundance Consulting, LLC is the only responsible resource available that can provide adequate NALEMP support, and no other supplies or services will satisfy contract requirements. THIS IS NOT A FORMAL SOLICITATION. This Notice of Intent is not a request for competitive quotations.

However, all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. All submissions will be evaluated for the sole purpose of determining whether competitive opportunities exist. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. A determination by the Government not to compete the contract based upon responses to this notice is solely within the discretion of the Government.

All responses received within 15 days will be considered. Late submissions will not be considered. Detailed responses to this notice shall be submitted to the following email addresses no later than 2:00 PM (Mountain Daylight Time), September 4, 2024; Loretta.D.Sanchez@usace.army.mil. Telephone responses will not be accepted. If no submissions are received, the government will proceed with the intended noncompetitive action.
