DWA National Fish Hatchery Special Notice/Request for Information

This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopses of Proposed Contract Actions." The U.S. Army Corps of Engineers, Walla Walla District intends to solicit a firm-fixed price construction contract to rehabilitate the Dworshak National Fish Hatchery Electrical Upgrades. A modernization of the electrical distribution has a requirement for the purchase of one switchboard, which will be used to reconfigure emergency power distribution at the Facility.

The proposed action will contain a brand name description to specify a particular brand-name product. The product to be specified is a Schneider Electric/Square D QED-style Switchboard for installation by a contractor at the Dworshak National Fish Hatchery. No other 480V, 2500A-rated QED-style electrical distribution system used in this capacity in this contract are compatible, therefore, the use of the brand -name description in the acquisition is essential to the Government’s requirement.

The Dworshak Powerhouse currently has seven switchboards and switchgear which currently use the same breakers and other components of the Schneider Electric/Square D system. The electrical upgrade at the Dworshak National Fish Hatchery can only install the Schneider Electric /Square D QED-style switchboard in order to remain compatible with the current powerhouse system.

The statutory authority for this brand name acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 6.302-1(c), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, application for brand name descriptions. The Government intends to solicit this action in May 2024. The NAICS code is 238210 Electrical Contractors and other Wiring Installation Contractors. The associated small business size standard as defined by the U.S. Small Business Administration is $19.0 million.

THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR BIDS. Interested concerns must show clear and convincing evidence that competition of this portion of the requirement would be advantageous to the Government. All responsible sources may submit a capability statement, proposal or quote to the contracting officer before the notice end date. If no affirmative written responses are received by 10:00 AM Local Time on the notice end date, a solicitation will be made without further notice.

Oral communications are not acceptable in response to this notice. A determination by the Government to include the brand-name product in the solicitation is solely within the discretion of the Government.
