This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 - Synopses of Proposed Contract Actions U.S. Army Corps of Engineers - Omaha District, intends to issue a Firm-Fixed Price contract to Burleigh County Law Enforcement Service, Burleigh County, North Dakota. The purpose of this acquisition is for Law Enforcement Services: The contractor shall provide services for additional law enforcement services in Corps Managed Kimball Bottoms Recreation Area.

The contractor shall conduct irregular patrols to the above listed area. During these patrols, the contractor shall enforce State and Local laws to ensure a quality and safe experience for our visiting public under the direction of the Government Representative.

The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 13.106-1(b) Soliciting from a single source (1) for purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action.

The NAICS code is 922120 is not related to Small Business standard. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. If no affirmative written responses are received by 2pm CDT on 14 March 2025, an award will be made without further notice. Oral communications are not acceptable in response to this notice.

A determination by the government not to compete this proposed requirement is solely within the discretion of the government. Responses and question shall be submitted to tina.l.keimig@usace.army.mil. The U.S. Army Corps of Engineers is not responsible for any costs incurred by responding to this notice.
