This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 - Synopses of Proposed Contract Actions U.S. Army Corps of Engineers - Omaha District, intends to issue a Firm-Fixed Price contract to Emerson Process Management Power & Water Solutions, Inc. of Pittsburgh, Pennsylvania, 200 Beta Dr, Pittsburgh, PA 15238. The purpose of this acquisition is to purchase new XX pump repair/rebuild kits and motor bearings.

These governor oil pumps were refurbished by American Governor in 2020-2022 and require maintenance to replace the oil pump consumables ever 5 years. American Governor has since been acquired by Emerson Process Management Power & Water Solutions.

The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 13.106-1(b) Soliciting from a single source (1) for purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this single source action.

The NAICS code is 333996, Fluid Power Pump and Motor Manufacturing. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. If no affirmative written responses are received by 2 pm CDT on 27 June 2024, an award will be made without further notice. Oral communications are not acceptable in response to this notice.

A determination by the government not to compete this proposed requirement is solely within the discretion of the government. Responses shall be submitted to Brianna.N.Wohlers@usace.army.mil. The U.S. Army Corps of Engineers is not responsible for any costs incurred by responding to this notice.
