The U.S. Army Contracting Command-Detroit Arsenal (ACC-DTA) intends to modify the existing Firm-Fixed-Price (FFP) T-9 Electro-Hydraulic (EH) Medium Dozer requirements contract W56HZV-21-D-0034 with Caterpillar, Inc to add the requirement for Technical Manual revisions. This action will be awarded on a sole source basis to Caterpillar, Inc. of Peoria, IL. The proposed contract modification is to incorporate the Electro-over-Hydraulic (EoH) procedures into the Technical Manuals supporting the T-9 Medium Dozer.

The Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1 “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” Specifically, FAR 6.302-1(a)(2)(ii) “Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in (B) Unacceptable delays in fulfilling the agency’s requirements”.

Caterpillar Inc. is the only source with the ability to fulfill the Army’s need for revised Technical Manuals. This is a notice of intent, not a request for competitive proposals, or a solicitation of offers. However, all responsible sources may submit a capability statement, bid, proposal, or quotation, which shall be considered by the agency. A determination not to compete this proposed contract action, upon response to this notice, is solely within the discretion of the Government.
