The U.S. Army Contracting Command - New Jersey (ACC-NJ), on behalf of the U.S. Army Combat Capabilities Development Command (DEVCOM) - Armament Center located at Picatinny Arsenal, NJ intends to solicit, negotiate, and award a firm fixed price purchase order to Spencer Group Inc., 9551 Kingtown Rd, Trumansburg, NY 14886-9225, for the purchase of one-year renewal of maintenance and updates for FactSage software and chemical databases.

Spencer Group Inc. is the only authorized distributor of FactSage software and software maintenance/support for the United States territory in which Picatinny, NJ is located. This notice is not a request for competitive proposals; however, all responsible sources may submit a capability statement, or proposal, which shall be considered by the Government.

The Authority for this procurement comes under Federal Acquisition Regulation (FAR) 13.106-1(b)(1), Spencer Group Inc. is the only known source who can meet the Government requirement. A Sole Source Justification was approved 13 December 2023 explaining that Spencer Group Inc. is the only source capable of providing the required software. The applicable NAICS code for this effort is 513210, the small business standard is $38.5M and the PSC Code is DA10.
