NOTICE OF INTENT TO SOLE SOURCE This notice is being published in accordance with Federal Acquisition Regulation (FAR) Subpart 5.101 requiring dissemination of information for proposed contract actions. This is a notice of intent to award a sole source firm-fixed price contract and is not a request for competitive quotes/proposals. The statutory authority for this sole source procurement is prescribed by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.
Background: To support operational communication needs, the U.S. Embassy Kyiv is required to obtain trunking communication services to maintain an exclusive radio network in Kyiv. The only one source is reasonably available on compelling need. While it is possible to find other contractors who could provide a similar range of services in a peaceful time, during Martial Law the Government of Ukraine does not issue any frequency licenses or permit transfer of existing licenses between vendors.
The U.S. Embassy Kyiv intends to award a a sole source firm-fixed price contract for a base year and two option years to VARTA, TOV on or about May 12, 2025. The ordering period will be twelve (12) months with anticipated maximum value of USD 135,000. The North American Industry Classification System (NAICS) code for this requirement is:
517810 All Other Telecommunications. This notice is not a request for proposals or quote. However, all responsible sources may submit a capability statement demonstrating the ability to provide the requested services, which shall be considered by the agency before the intended award date. Interested sources who submit data are responsible for appropriately marking information if it is proprietary in nature. The Government shall not reimburse interested sources for any information provided.
No requests for capability briefings will be honored. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
