NOTICE OF INTENT TO SOLE SOURCE SCENIC SERVICES

Notice of Intent to Sole Source THIS IS A Notice of Intent to Sole Source ONLY. The U.S. Government currently intends to award a contract for Scenic Support services on a SOLE SOURCE basis. The proposed sole source Firm Fixed Price contract to Legacy Scenic & Productions LLC. will be to provide Scenic Support services for The United States Army Band (TUSAB), “Pershing’s Own” Holiday Festival.

This annual event is part of an ongoing community relations program that showcases the Army’s most prestigious military band while bringing to the Washington, D.C. community a special insight to the Army through musical entertainment. The scenic set was designed and built by Legacy Scenic & Production LLC. and they are the only company with the proprietary knowledge of the customized venue with the ability to set up, make minor repairs/ fixes, and tear down and store the set properly. The statutory authority for the sole source procurement is FAR 13.106-1(b)

(1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name, or industrial mobilization.) This notice does not commit the U.S. Government to contract for any supply or service.

Further, the U.S. Government is not seeking quotes, bids or proposals at this time and will not accept unsolicited proposals in response to this notice. The U.S. Government will not pay for any information or administrative costs incurred in response to this notice. Submittals will not be returned to the responder. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.

However, if a competitive solicitation is released, it will be synopsized on the Governmentwide Point of Entry. It is the responsibility of potential offerors to monitor the Governmentwide Point of Entry for additional information pertaining to this requirement. The anticipated NAICS code is:
