Notice of Intent to award sole source

The DON OGC currently posts job openings through its public website, its internal website, and occasionally through the OPM’s USAJobs system. The DON OGC requires a method of reaching non-OGC attorneys that improves upon the reach of its existing methods. The USA Jobs system extends beyond internal and external website access, but it is limited to attorneys specifically seeking federal employment.

By contrast, the ABA job posting service reaches the significantly larger pool of attorneys who are not actively seeking federal employment. Furthermore, the ABA offers access to its resume bank of attorneys seeking employment, which will enable DON OGC to actively search for candidates. Approximately 1.3 million attorneys are licensed to practice in the United States.

A large number of those attorneys belong to the American Bar Association (ABA) (a July 2018 article indicated the ABA had 194,000 members and the ABA website indicates it has 28,725 “job seekers.” The ABA also offers a “TalentBoost Upgrade” service that posts job openings on commercial websites using an algorithm intended to drive more job seeker attention. No other organization offers a job listing service or job bank access as large as the American Bar Association.

YourMembership.com, Inc. is the sole source for posting job openings for legal personnel on it’s (i.e., ABA’s) career center job announcement site. YM Careers is the only known source for this requirement. The circumstances permitting Other Than Full and Open Competition is Federal Acquisition Regulation (FAR) 6.302-1, "Only one responsible source and no other supplies or services will satisfy Agency requirements."

The intent of this synopsis is to determine if any sources exist, and therefore, no Request for Quote (RFQ) is available. This notice of intent is not a request for competitive quotes; however, all information received by 30 August 2024, 11:00 am (EST) will be considered by the Government. A determination by the Government not to compete this proposed contract action based upon the responses received from this notice is solely within the discretion of the Government.
