This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the information in FAR Subpart 12.6, as supplemented with the additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. The solicitation number for this is N0018924Q0111 and will be issued as a request for quote (RFQ).

This solicitation documents and incorporates provisions and clauses in effect through FAC 2023-06 (effective 12-04-2023) and DFARS Publication Notice (Effective 1-22-2024). It is the responsibility of the contractor to be familiar with the applicable clauses and provisions. The NAICS code is 512230 and the Small Business Standard is 900 (number of employees). The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate a Firm Fixed Price contract with only one source, Kevin Day Music as represented by Murphy Music Press, under the authority of FAR 13.106-1(b)(1). Interested persons may identify their interest and capability to respond to the requirement or submit quotes.

This notice of intent is not a request for competitive quotes. However, all quotations received by the closing response date will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The Small Business Office concurs with this determination. The United States Navy Band requires the composition of one musical piece from composer Kevin Day. Please see attached performance work statement for additional information.

Job Performance Location: United Stated Navy Band 617 Warrington Ave, SE Washington Navy Yard DC 20374-5054 Period of Performance: Date of contract award through 30 NOV 2024. Method of Payment: Wide Area Work Flow (WAWF). Provision 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. Provision 52.212-2, Evaluation-Commercial Items, applies to this acquisition.

The Government will issue a sole-source award with prices proven fair and reasonable in accordance with the procedures at FAR 13.106-3(a)(2). Quoters are requested to include a completed copy of the provision at 52.212-3 (ALT 1), Offeror Representations and Certifications-Commercial Items, with the quote unless the representations and certifications have already been submitted online. Clause 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition.

Clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition.
