Naval Surface Warfare Center (NSWC), Crane Division, has requirement for a five-year, Indefinite Delivery Indefinite Quantity (IDIQ) contract for the production, acceptance, and delivery of the MK 25 Mod 0 Non-Lethal, 9-Bang Diversionary Hand Grenade.
The proposed contract action is for the supplies for which the Government intends to solicit and negotiate with one source, American Rheinmetall Munition Inc. (CAGE: 4XXK1), 2600 Park Tower Dr Ste 300, Vienna, VA 22180, under the authority of FAR 6.103-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
The requirement is being solicited on a sole source basis due to the lack of sufficient technical data, unacceptable duplicative costs to the Government that are not expected to be recovered through competition, and unacceptable delays in fulfilling the agency requirement through any other source. All responsible sources may submit a proposal, as appropriate, which will be considered by the agency.
However, a determination by the Government not to compete this proposed contract based upon responses to this pre-solicitation notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of re-evaluating the justification for sole source or limitation of sources and making a determination to change the acquisition strategy to a competitive procurement.
The solicitation and amendments for this sole source action will not be posted to sam.gov and are available only from the POC identified below. To challenge this sole-source determination, interested companies must demonstrate they possess the capabilities, facilities, and technical expertise to produce the MK 25 Mod 0 grenade.
All interested parties are encouraged to submit a capability package, including a white paper no longer than five pages, containing historical evidence of manufacturing, qualifying, and testing similar pyrotechnic or non-lethal munition solutions. Responses should also detail the technical aspects of the proposed solution, performance parameters, current availability, and lead times.
Furthermore, submissions should provide a budgetary estimate for test articles, production units, and production quantity breaks, identify other active or past Government contracts involving similar efforts, and state whether a demonstration of the grenade can be provided to expedite the Government's decision-making process.
Responses to this notice must include the submitter’s name, CAGE code, street address, business size status under NAICS 332993, and the name, email, and telephone number of the primary Point of Contact (POC). Additionally, contractors must be properly registered in the Government System for Award Management (SAM) prior to any potential award. Information on SAM registration and annual confirmation requirements can be obtained by calling 1-866-606-8220 or by visiting https://www.sam.gov.
At this time, no funding is available for this contractual effort. This notice does not constitute an Invitation for Bid (IFB), Request for Quote (RFQ), or Request for Proposal (RFP), and it should not be construed as a commitment of any kind by the Government to issue a formal solicitation or ultimately award a contract. The Government is in no way liable to pay or reimburse any companies or entities for costs incurred in responding to this announcement or participating in this market survey.
