SOLE SOURCE – RADIO UPGRADES

N00164-24-Q-0205 – SOLE SOURCE – RADIO UPGRADES – FSG J059 - NAICS 334220 ISSUE DATE 04-JUNE-2024 – CLOSING DATE 14-JUNE-2024 – 5:00 PM Eastern Time ITEM DESCRIPTION- Naval Surface Warfare Center (NSWC) Crane has a requirement for a quantity of 180 Radio upgrades converting radio part number 0N839880-3 to part number 0N839880-1. This action will provide the conversion of 180 radio from one variant to another. This will include loading software on the radio and changing the physical data place.

The final variant is required for the radio to be supported by Marine Corps maintenance. The final variant will be used by the Marines for communication purposes. SOLE SOURCE PROCUREMENT- The proposed contract action is for the supplies or services for which the Government intends to solicit and negotiate with one source L3HARRIS GLOBAL COMMUNICATIONS, INC. Cage Code 7QAK7 of Rochester, New York, under the authority of FAR 13.106-1.

This is being solicited on a sole source basis because the software loaded on the radio is proprietary to the Original Equipment Manufacturer, L3HARRIS GLOBAL COMMUNICATIONS, INC. and can only be performed by qualified technicians with the vendor. The vendor is neither willing to sell or allow the Government the use of the proprietary information to procure these upgrades from any other source.

If this upgrade is not procured through the OEM, the radios cannot by maintained and at a fault they will have to be replaced. The time lost to test new equipment with compatibility with existing radios, reconfigure new radios, and purchase new equipment would cost the Government in excess of 2 years of time and over $4 million dollars in cost. These costs would not be recouped in a competitive action. All responsible sources may submit a capability statement, which shall be considered by the agency.

However, a determination by the Government not to compete with this proposed contract based upon responses to this solicitation is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Contractors must be properly registered in the System for Award Management (SAM).

This solicitation is being issued pursuant to the procedures at FAR Part 13. Synopsis exception FAR 5.202(a)(13) applies and Solicitation Number N00164-24-Q-0205 is hereby issued as an attachment hereto. All changes to the requirement that occur prior to the closing date will be posted to Contract Opportunities on https://sam.gov/.

It is the responsibility of interested vendors to monitor https://sam.gov/ for any amendments, which may be issued to this solicitation. For changes made after the closing date, only those offerors that provide a quote will be provided any changes/amendments and considered for future discussions and/or award.
