1. INTRODUCTION & REQUIREMENT OVERVIEW:
The Department of the Navy, United States Marine Corps, Portfolio Acquisition Executive Marine Corps (PAE MC), intends to compete a requirement for the manufacture, testing, and delivery of Multi-Spectral Camouflage Overgarment. This acquisition is set aside 100% for Small Business concerns under NAICS code 313310 and PSC Code 8415. The procurement will be conducted in accordance with FAR Part 15 negotiated procedures for non-commercial supplies.

*** IMPORTANT NOTICE TO OFFERORS: DOMESTIC SOURCE RESTRICTIONS ***

Offerors are hereby notified that this planned acquisition is subject to strict domestic sourcing requirements under both civilian and defense acquisition regulations:

a. Buy American Act: In accordance with FAR Part 25 and DFARS Part 225, this procurement is subject to the Buy American Act. Any end products delivered under the resulting contract must qualify as domestic end products, meeting all applicable domestic content thresholds.

b. The Berry Amendment (10 U.S.C. 3841 / formerly 10 U.S.C. 2533a): Because this is a Department of Defense procurement, the Berry Amendment is fully applicable. All covered items (including but not limited to clothing, fabrics, fibers, yarns, other made-up textile items, and specialty metals, as applicable) must be 100% grown, reprocessed, reused, or produced in the United States, unless a specific statutory exception applies.

The forthcoming solicitation will contain all applicable provisions and clauses detailing these requirements, including DFARS 252.225-7001 (Buy American and Balance of Payments Program) and DFARS 252.225-7012 (Preference for Certain Domestic Commodities). It is the sole responsibility of the offeror to ensure their supply chain complies fully with these regulations prior to proposal submission.

2. CONTROLLED UNCLASSIFIED INFORMATION (CUI) & CYBERSECURITY MANDATES:
The technical specifications, Statement of Work (SOW), and Purchase Description (PD) associated with this requirement contain Controlled Unclassified Information (CUI), specifically categorized as Controlled Technical Information (CTI). The resulting solicitation and contract will include strict information safeguarding requirements. To be eligible for award, offerors must comply with the following DFARS provisions and clauses, which will be incorporated into the solicitation:

DFARS 252.204-7012, Safeguarding Covered Defense Information and Cyber Incident Reporting
DFARS 252.204-7019, Notice of NIST SP 800-171 DoD Assessment Requirements
DFARS 252.204-7020, NIST SP 800-171 DoD Assessment Requirements

Section III: SOW & Purchase Description (PD) Access Protocol
The SOW and Purchase Description will not be publicly posted to SAM.gov. To obtain access to these restricted CUI/CTI documents, prospective offerors must complete the vetting process detailed in the table below:

Cybersecurity & JCP Verification: Provide proof of an active Joint Certification Program (JCP) certification number (DD Form 2345) and verify that a NIST SP 800-171 self-assessment has been uploaded to the Supplier Performance Risk System (SPRS). The Contracting Officer will independently verify SPRS scores and JCP status. Requests lacking active credentials will be rejected.
3. Execution of NDA: Sign and return the Government-furnished Non-Disclosure Agreement (NDA) governing the handling of CUI/CTI.  Must be executed by an authorized corporate officer with binding authority.
4. Secure Distribution: Upon verification, the Government will transmit the SOW and Purchase Description. Direct email is prohibited. Delivery will occur exclusively via DoD SAFE (Secure Access File Exchange) using encrypted, password-protected links.
