Notice of Intent to Sole Source

USACE - Buffalo District intends to increase IDIQ AE SATOC contract capacity for W912P421D0006 from $35M to $70M.

Authority Cited: 6.302-1(a)(2)(iii) - for DoD, NASA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in- A. Substantial duplication of cost to the Government that is not expected to be recovered through competition B. Unacceptable delays in fulfilling the agency’s requirements THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS and a solicitation will not be issued.

Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. If no affirmative written responses are received by the date indicated in this post, award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the government not to compete this proposed action is solely within the discretion of the government.

Description of the Action to be Taken: The Buffalo District Office is requesting additional IDIQ capacity for W912P421D0006 (AE SATOC). On 8 June 2021, JE Architects/Engineers PC (Jacobs) was awarded a $35M IDIQ to completely design the remediation and disposal of the Interim Waste Containment Structure (IWCS), part of the Formerly Utilized Sites Remediation Action Program (FUSRAP) at the Niagara Falls Storage Site (NFSS).

Due to a significant increase in the estimated construction and remediation costs, an additional $30M is being requested to complete the 100% design. The government's intent is to pursue a justification and approval IAW the cited authority. Jacobs is the designer of record. Any effort to reprocure will significantly increase costs and result in unacceptable delays.
