NOTICE OF INTENT TO AWARD A SOLE-SOURCE PURCHASE ORDER

NOTICE OF INTENT TO AWARD A SOLE-SOURCE PURCHASE ORDER Army Contracting Command – Aberdeen Proving Ground (ACC-APG), Tobyhanna Division, Tobyhanna, PA 18466 intends to award a sole source purchase order to Wilkinson Systems, LLC, 4480 Camille St., Holladay, Utah 84124. This requirement is for one year only Automatic Storage and Retrieval System (ASRS) Software Maintenance Support. The contractor will perform required software maintenance for the ASRS system located at Tobyhanna Army Depot (TYAD).

This legacy software was developed by the Wilkinson Systems, LLC for Tobyhanna Army Depot’s (TYAD) Automated Storage and Retrieval System (ASRS). Therefore, Wilkinson Systems, LLC solely owns the data rights to the source code making them the sole proprietor of the software. Replacing this software would require re-engineering ASRS. The Government intends to acquire this software support under the guidelines of FAR Part 13, Simplified Acquisitions Procedures and FAR Part 12, Commercial Items.

The Government intends to solicit and negotiate directly under the authority of FAR 13.106-1(b)(1). This is not a solicitation for competitive quotes. However, if any interested party that can provide this requirement, without compromising manufacturing delivery, warranty, or mark ups, you may submit a statement of capabilities that may be considered by Tobyhanna Army Depot.

A determination by the Government not to compete this proposed requirement is based upon responses to this notice and it is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.

The capability statement, a price list and any other information furnished must be via email only and must contain material in sufficient detail to allow the Government to determine if the party can meet the requirements. Capability statements and related materials must be e-mailed to Dean Berkovics at dean.m.berkovics.civ@army.mil by 10:00 AM EST on 12 JULY 2024.
