AMes Research Center has a Brand Name Requirement for Atlassian services. See the attached Statement of work for part numbers and descriptions of the requirement. See attached RFQ for other terms and conditions. Offeror’s shall provide pricing for all items requested in the statement of work. Partial quotes will not be accepted.

To ensure that authentic Atlassian software is purchased, the vendor shall certify that it is an Original Equipment Manufacturer ("OEM”) Authorized Channel Partner as of the date of the submission of their offer, and that it has the certification/specialization level required by the OEM to support both the product sale and product pricing, in accordance with the applicable OEM certification/specialization requirements.

The Vendor confirms to have sourced (or will source) all OEM products submitted in this offer from the OEM or through the OEM’s Authorized Channels only, in accordance with all applicable laws and current OEM’s applicable policies, at the time of purchase. Unless otherwise specified, Vendor shall warrant that all products are (or will be) new and in their original box.

Where applicable, Vendor shall provide Buyer with a copy of the End User license agreement and shall warrant that all OEM software is licensed originally to Buyer as the original licensee authorized to use the OEM Software. Buyer reserves the right to validate with the OEM all products delivered to ensure compliance with the above provisions.

By making an offer, Vendor consents to no cost cancellation of the non-compliant awarded items if, upon inspection or OEM registration after delivery: - any products provided are not recognized or acknowledged by the OEM as new and original products, or - any products provided are not recognized or acknowledged by the OEM as having been supplied through authorized distribution channels in the United States, or - that offeror was not appropriately authorized by the manufacturer to sell the product. Offeror’s shall be registered at www.sam.gov in order to be considered for award. Quotes shall state the offeror’s UEI and Cage Code. Delivery is FOB Destination.
