Notice of Intent to Sole Source - ATS Rental

The purpose of this synopsis is to announce the Phoenix Area-Indian Health Service’s intent to negotiate a firm fixed price on a sole source basis with Empire Power Systems; 840 N. 43rd Avenue, Phoenix, AZ 85009 to provide a 4-month rental of an Automatic Transfer Switch (ATS).

This procurement is conducted pursuant to the authority of FAR 13.106-1(b)(1)(i) Only one (1) source [Empire Power Systems] is available to fulfill the Government’s requirement for a 4-month ATS rental in place of a damaged unit at the Phoenix Indian Medical Center (PIMC). This action will support PIMC in the short-term and allow adequate time to complete the acquisition process for a new equipment replacement and prevent any lapse of the agency’s requirements to provide safe medical services.

Due to the urgency of the need, Empire Power Systems is the only acceptable source for the 4-month period and an alternate vendor would incur unacceptable delays.

Estimated cost range of this rental service is $30,000 - $35,000 THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS: However, interested firms may submit a capability statement in response to the above requirement with pricing information by August 19, 2024 @ 3:00 PM Mountain Standard Time to Kenny Nicholson, Contract Specialist at email: Kenneth.Nicholson@ihs.gov. A determination not to open competition based on responses to this notice is solely within the discretion of the Government.
