Special Notice Notice of Intent to Award a Sole Source Procurement The Department of Veterans Affairs, Veterans Health Administration, Network Contracting Office 17, intends to place a firm-fixed priced contract/order with Sirtex Medical Inc. for the procurement of the following items:

0001: SIR-Spheres® yttrium (Y-90)

0001AA:

SIR-Y001/SIR-Y002, Y-90 Resin Microspheres 0001AB:

Y-90 DD, Dose Draw 1 0002:

SIROS Delivery System 0002AA:

SIR-10100, SIROS Delivery Dome 0002AB:

SIR-10200, SIROS D-Vial Prep Set 0002AC: SIR-10300, SIROS Delivery Set The proposed sole source procurement will be made by an open market pricing agreement with Sirtex Medical Inc. Sirtex Medical Inc. provided a sole source letter stating that SIR-Spheres® are manufactured, sold, and distributed exclusively (by Sirtex Medical Inc.). This notice is not to be considered a request for quotations or proposals.

No contract will be awarded based on offers received in response to this notice; however, all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Proposals or offers received will be used to determine if a comparable source is available and more advantageous to the government.

If no affirmative written response is received within 7 days from the publication of this notice, a contract or order will be issued to Sirtex Medical Inc. without any further notice. The anticipated statutory authority permitting other than full and open competition for the requirement is 41 U.S.C. 3304(a)(1), as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.
