This is a notice of intent to award a sole source contract and is not a request for proposals. The Department of Veterans Affairs on behalf of the Clement J. Zablocki VA Medical Center (Milwaukee VAMC) intend to award a Firm Fixed Price (FFP), sole source action to:

507 E Michigan St City, State, Zip: Milwaukee, WI 24164 The objective of this action is to replace two Rooftop Unit (RTU)s on Bldg. 70- One RTU (size: 25 ton) serves the second floor of E-wing the offices of OQM. This is called South Unit (east side of roof). The other RTU (size: 30 ton) serves the second floor of E-Wing, the Offices of Facilities Management.

These buildings are located at the Clement J. Zablocki VA Medical Center, 5000 W. National Avenue, Milwaukee WI 53295. Johnson Controls is the Milwaukee VA s sole source for HVAC controls. Currently the Milwaukee VAMC utilizes Johnson Controls Metasys platform for all HCAV building controls. These RTUs in this procurement must be programmed and tied into this proprietary control system.

The Rooftop Units are one for one replacement and must be connected to the existing controls wiring, and frame assembly attached to the roof system. Johnson Controls is the owner of York rooftop units products and is responsible for upholding all manufacturer warranty for said equipment and its proprietary control system. These are the only rooftop units that allows for a one for one replacement without extensive additional design and construction modifications to the existing site on the roof for placement.

Competition for this action is being restricted due to the fact that Johnson Controls Metasys system is firmly embedded into the Milwaukee VA s overall HVAC system, they are the one and only source that can satisfy the Government s requirement. This notice of intent to sole source with justification for brand name only satisfies the public posting requirements of FAR.

Market research was conducted in accordance with FAR part 10. This notice is not a request for proposals; however, all responsible sources may submit a capability statement which shall be considered by the Government. All capability statements must be received by no later than 5:00 PM Central Standard Time on August 21, 2024. Responses to be submitted to Ryan McMillin, Contracting Officer at Ryan.McMillin@va.gov.

A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. The actual justification will be posted with the award notice when completed.
