Medtronic Ventilator Batteries - Notice of Intent to Sole Source

Notice of Intent to Sole Source Requirement Department of Veterans Affairs, VISN 10, Cincinnati VA Medical Center 3200 Vine Street, Cincinnati, OH 45220, intends to negotiate a sole source contract under Simplified Acquisition Procedures and the authority of FAR Part RFO FAR 12.102(a), Acquisition of Commercial Products and Commercial Services, and in accordance with (IAW) GSAR 538.7104-3, Only One Responsible Source for 52 Medtronic Ventilator LI-ION Batteries. The associated NAICS code for this is 335910 (Battery Manufacturer). The vendor will be Covidien Sales LLC (Medtronic), 15 Hampshire St, Mansfield, MA 02048, large business, original equipment manufacturer (OEM). Description of Equipment or Supplies: ITEM NUMBER DESCRIPTION QTY 10086042 980 Rechargeable LI-ION Battery 52 Cincinnati VAMC Biomedical Department currently utilizes OEM s ventilators and batteries. Some of the current life support equipment are receiving battery end of service life messages. The requested batteries are the only equipment that will integrate with the existing Medtronic PB980 Ventilator systems. The specifications needed by the end-user could not be met or shown compatible with any other product examined. In the interest of consistency, compatibility, interchangeability, and ability to continue with current services, it is in the best interest of the VA to remain with OEM equipment. A firm-fixed price contract with no option years is anticipated and shall be awarded. It is the Government's belief that only the proposed candidate possesses the required capabilities to successfully meet this requirement. It is the Government's intention to solicit and negotiate with only this source. This notice of intent is not a request for competitive proposals. It is not a solicitation or request for offers. No solicitation package is available. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government.
