Notice of Intent to Sole Source AMERGINT Technologies, Inc. AMERGINT Maintenance and Support This is a Notice of Intent to issue a sole source contract to AMERGINT Technologies, Inc. (AMERGINT), an ARKA Group Company, located at 2315 Briargate Parkway, Suite 100, Colorado Springs, CO 80920. The U.S. Department of Commerce, National Oceanic and Atmospheric Administration (NOAA), Acquisition and Grants Office, Satellite and Information Acquisition Division (SIAD) intends to negotiate with AMERGINT on a sole source basis in accordance with FAR 13.106-1(b)(1).

The AMERGINT product is required to uplink the NOAA/High Rate Information Transmission (HRIT) to the Geostationary Operational Environmental Satellites-R Series satellites for distribution of Emergency Managers Weather Information Network weather forecasts, warnings, graphics, and other information as well as low-resolution GOES satellite imagery data to remotely located user HRIT Terminals.

Without the AMERGINT maintenance renewal, product outages and security issues would be jeopardized during a serious weather event which would adversely affect weather preparedness in remote locations, the health & safety of the public and the Government infrastructure. Thus, not procuring the AMERGINT renewal would present an unacceptable impact to the Government. No other product will meet the Government’s Requirements. NOAA/OSPO has a requirement to renew the AMERGINT maintenance and support contract. AMERGINT has been determined to be the sole source provider of AMERGINT maintenance and support/AMERGINT’softFEP-9000 based on the following:

1) The proprietary nature of the AMERGINT product;

2) The acquisition history showing Government sole source awards to AMERGINT for the same proprietary AMERGINT product; and, 3) A sole source letter from AMERGINT stating that it does not use resellers or third parties to sell or support AMERGINT products. The Government anticipates awarding a firm-fixed-price contract. The North American Industry Classification System Code is 517410--Satellite Telecommunications, with the size standard $44 million dollars, is applicable to the Government’s Requirements.

This notice is not a request for competitive bids, quotes or proposals; however, any vendor that believes it can fully meet the Government’s Requirements may submit written documentation affirmatively demonstrating its ability to meet the Government’s Requirements to the Contracting Officer and Contract Specialist, listed in this notice, within six (6) calendar days of this notice post-date.

Vendor documentation that may be submitted in response to this notice will be considered only to determine whether to proceed with the intended sole source acquisition. A determination by the Government not to conduct a competitive acquisition, and proceed with a sole source acquisition, based on potential submissions to this notice is solely within the discretion of the Government.

Any documentation submitted in response to this notice is strictly voluntary; therefore, the Government: 1) will not pay for any documentation submitted in response to this notice and will not pay for vendor time used to respond to this notice; and, 2) will not award a contract solely based on documentation submitted in response to this notice.
