Synopsis - Notice to Sole Source: NOTICE OF INTENT TO ISSUE A SOLE SOURCE CONTRACT The Bureau of Safety and Environmental Enforcement (BSEE), pursuant to Federal Acquisition Regulation (FAR) 6.302-1(a)(2), intends to issue a sole source contract to AMOG Consulting. The Bureau of Safety and Environmental Enforcement (BSEE) anticipates awarding a sole source contract to AMOG Consulting for follow-on work to the Dispersant Spray Drift Decision Support Tool (DST) initially developed under previous BSEE contracts.

The DST is intended to assist spill response planners in identifying operational windows and setback distances based on weather conditions, aircraft types and release rates. This sole source requirement will continue to refine the development of DST by addressing recommendations of a Peer Review (contract 140E0122F0070) conducted on the tool and the user manual. The recommendations included modeling for additional aircraft, software enhancements and user manual improvements.

In accordance with FAR 6.302-1(a)(2)(ii), supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition or, (B) Unacceptable delays in fulfilling the agency¿s requirements.

This decision support tool was initially developed under previous BSEE contracts E15PC00015 and E0119C0004 and Peer Reviewed under contract 140E0122F0070. AMOG has invested significant time and resources in this technology and uniquely designed the system. AMOG has the expertise to address the peer review recommendations and implement upgrades. A new contractor would have to duplicate time and resources to develop the technology to its current state.

The program office wishes to proceed with development in the most time and cost effective method. The original solicitation in 2015 was through a BAA no. E15PS00027. The proposal AMOG submitted under went a TPEC review along with the other offerers that submitted under this BAA. From the TPEC consensus, AMOG was awarded the contract. AMOG developed a very unique decision tool to determine the dispersant drift from aerial applications.

For this tool to be fully operationally and relevant to the response activities currently available, further work is essential to advance this tool to the next step. MOG has the expertise to address the peer review recommendations and implement upgrades. A new contractor would have to duplicate time and resources to develop the technology to its current state.

Therefore, this acquisition will result in a sole source contract to AMOG Consulting in accordance with FAR Part 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

PLEASE NOTE: This notice is not a request for proposal (RFP). However, any firm that believes itself capable of meeting the requirement described herein may submit a capability statement or quotation which may be considered if received by the agency by 5:00pm Eastern Time on 5 September 2024. All submissions in response to this notice must be submitted in writing via email to the Contracting Officer at william.rilee@bsee.gov reference "Solicitation 140E0124Q0086" on the subject line. A determination by the Government not to compete the Government's requirements described in this notice is solely within the discretion of the Government.
