Brand Name Requirement - CHCNAV i83 Real Time Kinematic (RTK) GNSS Kits and Accessories

The National Oceanic and Atmospheric Administration (NOAA) intends to award a firm-fixed-price purchase order for brand name CHCNAV RTK GNSS hydrologic survey equipment and accessories under the authority of 41 U.S.C. 3304(a)(1) and RFO

FAR 12.102(a). The CHC NAV survey equipment is to be purchased through a United States based reseller. A total small business set aside is to be used for this requirement. The associated NAICS code is 334220. This justification posting is not a request for competitive proposals nor an invitation for price quotes. The CHC NAV equipment for this purchase order is exempt from the Buy American Act under the Revolutionary FAR Overhaul (RFO)

FAR 25.103(e) as it is Information Technology that is a commerical product. This purchase order is compliant with RFO

FAR 40.204.2 and Section 889 of the John S. McCain National Defense Authorization Act (NDAA). RFO

FAR 40.204-2 and Section 889 specifically restricts the procurement or use of covered telecommunications and video surveillance equipment or services from designated covered entities (Huawei Technologies Company or ZTE Corporation or any subsidiary or affiliate of such entities). It does not impose a general prohibition on all electronics or commercial hardware made in China. Please note, this acquisition is for the Department of Commerce (DOC) and not the DOD; as such the DoD 1260H banned list of "Chinese Military Companies" does not apply.
