Market research indicates that GSA can adequately fulfill the need for the bear-proof storage lockers, but not the need for the bear- proof dumpsters. BEARICUDA, INC. is the only firm capable of providing all supplies without the USDA Forest Service experiencing substantial duplication of administrative and delivery costs that cannot be expected to be recovered through competition and/or unacceptable delays in fulfilling its requirements.

The Government has high confidence that BEARICUDA, INC. understands the requirement, proposes a sound product, and will be successful in performing the contract with little or no Government intervention. An informal analysis of prices or examination of the market indicates that the BEARICUDA, INC. price is consistent with those prices available in the market. BEARICUDA, INC. has unique knowledge and special capabilities needed for this project.

The past performance record of BEARICUDA, INC. has been outstanding, they have vast experience in this area, proposed products are extraordinarily qualified, and the offeror proposes a price that, had this requirement been further competed, would not be more advantageous. BEARICUDA, INC., is the Best Value with consideration of Project needs and results in the lowest overall cost alternative to meet the needs of the Government.

The U.S. Forest Service, under the authority of the FAR Subpart 13.5 authority of 41 U.S.C. 1901; (modified FAR 6.302- 1), intends to issue a firm fixed price, sole source purchase order to BEARICUDA, INC. for the bearproof dumpster and storage locker. NO SOLICITATION OR REQUEST FOR QUOTE IS AVAILABLE. Contractor selected is capable of supplying the requirements because of their experience within this field of outdoor animal security and has the necessary products to adequately provide the requirement needs.

Contractor selected also has explicit and intimate knowledge of the specific project for which those products are required. Notwithstanding, interested parties who believes they are capable of meeting Forest Service requirements as stated herein may submit a response that shows clear and convincing evidence that competition would be advantageous to the Government in future procurements. This notice is not a request for competitive proposals or a solicitation of offers.

A determination not to compete the proposed Purchase Order based upon the responses is solely within the discretion of the Government.
