Third Street, Dayton, Ohio 45428 intends to solicit and negotiate with only one source under the authority of FAR 6.302-1(a)(2), Only one responsible source and no other supplies or services will satisfy agency requirements.

The VA intends to solicit and negotiate with Siemens Medical Solutions USA, Inc., 40 Liberty Blvd., Malvem, PA 19355, for Artis Q Windows Upgrade Software. Siemens does not have any authorized Small Business distributors. The Healthcare Technology Management Service at the Dayton VA Medical Center requires an upgrade to our Siemens Artis Q (EE 66055) from Windows 7 to Windows 10, as well as provide training on the upgraded OS.

Siemens Medical Solutions USA, Inc., is the sole manufacturer; only Siemens Medical Solutions USA, Inc., can provide the VA with the proprietary software updates and upgrades for our equipment, no other software has been validated for these systems.

The Government believes that only Siemens Medical Solutions USA, Inc., can satisfy the agency requirements and intends to negotiate with only one source under the authority of FAR 6.302-1(a)(2), Only one responsible source and no other supplies or services will satisfy agency requirements.

Other persons may identify their interest and capability to respond to this requirement by Wednesday, January 24, 2024 by 5PM EST. Such capabilities information will be used solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. All information shall be furnished at no cost or obligation to the Government. A determination by the Government not to open the requirement to competition based upon responses to this notice is solely within the discretion of the Government.

Brief Description of Supplies/ Services required and the intended use/Estimated Amount: Siemens will provide engineering services to upgrade our Siemens Artis Q (EE 66055) from Windows 7 to Windows 10 as well as provide training on the upgraded OS.

Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Siemens Healthineers is in possession of proprietary information directly associated with the upgrade. Siemens Healthineers is the sole manufacturer of the required updates and upgrades for their equipment; no other software has been validated for their systems.

Description of market research conducted and results or statement why it was not conducted: The CO searched VetCert using NAICS 513210 resulted 96 SDVOSBs and 30 VOSBs. Using the same NAICS searched DSBS, resulted 293 SDVOSBs and 74 VOSBs. Added keywords, Artis Q Windows Upgrade, resulted 0. The VA Rule of Two is Unattainable.
