FY24: Vascular Surgical Instruments

Vascular Surgical Instruments for the Veterans Affairs Caribbean Healthcare System (VACHS), RFQ no. 36C24824Q1329.

The purpose of this amendment is to cancel the solicitation, due to an incorrect determination regarding the applicability of a waiver of the Non-Manufacturing Rule (NMR) for NAICS code 339112. During the Market Research phase of this procurement, this office made the incorrect determination that the Small Business Administration's (SBA) inclusion of NAICS code 339112 on the NMR waiver list meant that the NMR for all procurements under such NAICS were waived.

Under such understanding, as well as the determination that the VA Rule of Two was met during the MR phase, a set-aside for Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) was made, after following the NMR decision tree found at the Veterans Healthcare Administration's Procurement Guide (VHAPG) 810.001. However, it was later determined that the NMR waiver for NAICS code 339112 was specific for Continuous Positive Airway Pressure (CPAP) manufacturing, and not for all procurements under said NAICS.

As a result of the above determination and following the same NMR decision tree found at the VHAPG 810.001, a set-aside should ve been made to Small Businesses and not SDVOSBs, since there is no applicable waiver for the NAICS code of this procurement. Therefore, the Request for Quote no. 36C24824Q1329 is hereby cancelled, and will be re-procured under another solicitation which will be set-aside for Small Businesses.
