This is a notice of the Government s intent to award a sole source, open market purchase order under 41 U.S.C. § 1901, as implemented by FAR 13.106-1(b)(2). The justification for this sole source action is the authority at FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
The Veterans Integrated Service Network 6 (VISN 6) intends to negotiate a sole source purchase order with Baxter Healthcare Corporation (UEI: RSKLEFCZ6127) for the supply of twenty-one (21) AK98 dialysis machines. The Baxter AK98 dialysis machine was selected by the facility for standardization of hemodialysis devices across Durham VA Health Care System facilities. Staff familiarity with a standardized device reduces the risk of errors that could affect patient safety.
Use of devices from different manufacturers or different models between facilities increases staff training requirements and increases costs for managing consumables, parts and maintenance. Standardizing machines ensures the Durham VAHCS biomedical team can more efficiently manage equipment maintenance, reducing downtime and operational disruptions.
The AK98 is already in use at the Brier Creek VA Dialysis Clinic located at 8081 Arco Corporate Drive, Suite 130, Raleigh, NC 27617. The clinic is part of the Durham VA Health Care System. The AK98 and competing machines are intended for use by trained operators.
All deliveries will be made to the Durham VA Medical Center (main facility) located at 508 Fulton Street, Durham NC 27705. The applicable NAICS code is 334510, ELECTROMEDICAL AND ELECTROTHERAPEUTIC APPARATUS MANUFACTURING (SBA Size Standard: 1250 employees). This Notice of Intent is not a request for competitive quotes. No solicitation documents are available and telephonic requests will not be taken.
However, if a party believes it can meet supply an equivalent product it must furnish information about its capability, as well as references from other customers who are using these products and services to the Contracting Officer by 05:30PM Eastern Time on Thursday, April 17, 2025. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to provide an equivalent item.
Responses received will be reviewed, however; a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. After the closing date and time of this notice, if no other substantiated sources are identified, the Contracting Officer will proceed with the sole source action. Capability statements shall be submitted by email only, as either an MS Word or Adobe PDF attachment, to Daniel Spaulding at daniel.spaulding@va.gov. TELEPHONIC INQUIRIES WILL NOT BE ACCEPTED.
