Sole Source - ACD Labs - Precepta software suite

This is a NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT. The Army Contracting Command, Tenant Contracting Division, 6565 Surveillance Loop Rd, Aberdeen Proving Ground intends to issue a sole source, Firm-Fixed Price contract, under Federal Acquisition Regulation (FAR) 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements, 10USC 2304 ( c ) (1) to Advanced Chemistry Development, Inc. (ACD/Labs),8 King Street East, Suite 107, Toronto, Ontario M5C 1B5 Canada Cage Code: L4098. NAICS Code is 513210 and Business Size standards $47,000,000. The contractor shall provide the following:

Qty Item Description Period of Performance: Base Year 5/1/2024-4/30/2025 1 ACD/Percepta Suite (incl. PhysChem Suite) Batch, Stand-Alone Seat Subscription ACD/ Labs is the original designer and manufacturer of the ACD/Percepta Suite, and they are also the original equipment manufacturers (OEM) support technicians and there are no other vendors that can perform maintenance and repair. Other contractors may have their own system but are not able to support ACD/ Labs technology.

Only the vendor can provide qualified support technicians. (See detailed description – attached). Please see the attachment labeled, “justification” for further detail as to why this action is being negotiated solely with ACD/ Labs, Cage Code: L4098 There are no solicitation documents; however, contractors interested in this requirement should submit a complete technical package, which provides clear and convincing evidence that they can meet the Government’s requirement.

Vendors who are not registered in System For Award Management (SAM) database prior to award will not be considered. Vendors may register with SAM by going on via web to https://www.sam.gov. Responses must be received no later than 5:00 PM., Eastern Daylight Time, 12 April 2024. Responses should be submitted electronically to Andrew.a.bragason.civ@army.mil This notice of intent is not a request for competitive proposals; however, the government will consider all responses received by the response date stated above.

A determination by the Government not to compete this acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. TELEPHONE REQUEST WILL NOT BE HONORED.
