Notice of Intent to Sole Source – RS Means 2024 Network License Agreement for CostWorks CD. Contract No. TBD. This Notice is being published in accordance with Federal Acquisition Regulation (FAR) requiring the dissemination of information on proposed contract actions. This is a notice of intent to award a sole-source contract. The statutory authority for this sole-source procurement is 10 United States Code 2304(c)(1) as implemented in Federal Acquisition Regulation 8.405-6(a)(1)(B).

Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. Products and services are brand names and are proprietary to the specific provider. The United States Army Corps of Engineers (USACE) Baltimore District (NAB) intends to solicit and award a Firm-Fixed-Price Sole Source Contract to R.S. Means Company LLC to provide RS Means 2024 Network License Agreement for CostWorks CD.

This acquisition is for the purchase of 50 licenses for CostWorks software. This software will provide those District Divisions that chose to participate in this consolidated purchase the ability to:

Provide timely cost estimates feedback from project stakeholders which is critical for avoiding costly changes during construction, provides a wide variety of data that allows the user to quickly and easily generate an accurate cost analysis of a new project or renovation and allow the reviewer to perform faster, more accurate and more thorough estimate reviews. The Period of Performance is five (5) months base and one (1) year option from the date of contract award.

All responsible sources may submit a capability statement, which shall be considered by the agency. Capability statements must be received by the response date and time of this notice. Submissions will be reviewed to determine if they can meet the requirement. A determination by the Government to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The redacted approved Justification and Approval, (J&A) for this procurement will be posted following the closure of this Notice.
