THIS IS A SPECIAL NOTICE PREPARED IN ACCORDANCE WITH FEDERAL ACQUISITION REGULATION (FAR) SUBPART 5.2 “SYNOPSES OF PROPOSED CONTRACT ACTIONS” 238220 – Plumbing, Heating, and Air Conditioning Contractors Response Deadline: 27 March 2025 The U.S. Army Corps of Engineers (USACE), Portland District (NWP) intends to negotiate/award a firm-fixed price (FFP) service, single source procurement to Fire Solutions of SIEMENS Industry, Inc. (Siemens) to repair, test, and re-certify the water mist system that protects the oil rooms and transformer vaults at The Dalles Dam REASON FOR SOLE SOURCE ACQUISITION: The statutory authority for this non-competitive acquisition is FAR 13.106-1(b)(i), Soliciting from a single source for purchases not exceeding the simplified acquisition threshold.

The purpose of this requirement is to repair, test, and re-certify the water mist system that protects the oil rooms and transformer vaults at The Dalles Dam located in Klickitat County, Washington.

Background: The Fine Water Mist System protects the oil rooms and two transformer vaults at the Dalles Dam in the event of a fire in those spaces. CENWP has been receiving numerous OSHA complaints with regards to the lack of maintenance and testing of the Fine Water Mist System beginning with a complaint on November 19th, 2019. On November 25th, 2020, an inspection was performed by Convergint Technologies on the Fine Water Mist system. The controls components on the system were then determined to be defective.

A contract for these services was advertised in 2024, Solicitation No W9127N24Q0124 posted on SAM.GOV on 19 AUG 2024 with a closing date of 03 SEP 2024. Two (2) proposals were received in response to this solicitation, and both were found technically unacceptable. A sources sought notice for this requirement was posted to SAM on 19 December 2024 and received one response, which after review was determined to be technically unacceptable.

Justification: The Fine Water Mist System has a Siemens brand name controller. Only those with Siemens certifications can replace the controller in kind, go online and program the controller, the remote annunciator, and other components. If this contract were solicited without a sole source, any successful bidder would need to subcontract with Fire Solutions of SIEMENS Industry, for the replacement and re-certification of the system to be successful.

Impact: Without receiving remediation services, the Fine Water System could fail in the event of a fire, and spaces containing the special hazards protected by the Fine Water System would continue to burn which could substantially increase the damage and remediation costs to USACE. The Government intends to solicit Siemens Industry, Inc. directly for this project on or around 5-April-2025. At this time, a solicitation does not exist.
