Notice of Intent to Sole Source Brand Name - Raystown Lake Aquatic Herbicide

NOTICE OF INTENT TO SOLE SOURCE- Raystown Lake Aquatic Herbicide, Raystown Lake, Hesston, PA, Contract No. TBD This Notice is being published in accordance with Federal Acquisition Regulation (FAR) requiring the dissemination of information on proposed contract actions. This is a notice of intent to award a brand name sole-source acquisition.

The statutory authority for this sole-source procurement is 10 United States Code 2304(c)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2), “Only one responsible source and no other supplies or services will satisfy agency requirements.” The United States Army Corps of Engineers (USACE) Baltimore District (NAB) intends to include the following items in a request for quote for an aquatic herbicide plant control services acquisition under the authority of FAR 6.302-5(a)(2)(ii), Authorized or required by statute.

This project will include Brand Name Only items, as described below, unless the result of this notification indicates otherwise. Only the requiring brand name items will be sole sourced if no sources are able to prove an equal product.

Requirements: In general terms, the project includes an aquatic herbicide service contract to treat invasive aquatic plants on approximately 72 acres of water at Raystown Lake, Hesston, PA. The chemicals necessary to the invasive plant control will require a brand name sole-source acquisition and are listed herein. The estimated delivery period for these items will be in accordance with commercial practices. The Brand Name Only items are described below:

SONAR ONE – Manufactured by SeaPRO Granular form of fluridone that provides a slow release of fluridone over a 3-week period. During this time concentrations are as low as 3ppb, which is what makes this treatment so effective. HARPOON GRANULAR - Manufactured by SeaPRO Chelated copper complex that weakens the aquatic plants and allows the aquathol to be most effective.

AQUATHOL SUPER K - Manufactured by United Phosphorous Inc. Granular form of endothall which provides a 2-day slow release of the chemical to increase target plant contact time. This notice is NOT a request for quotes. All responsible sources may submit a capability statement, which shall be considered by the agency. Capability statements must be received by the response date and time of this notice. Submissions will be reviewed to determine if they can meet the requirement.

A determination by the Government to not sole source the items listed above will be based upon responses to this notice and is solely within the discretion of the Government. The approved Justification and Approval, (J&A) for this procurement will be posted following the closure of this notice.
