NOTICE OF INTENT TO SOLE SOURCE The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis under the authority of FAR 13.106-1(b)(1) Soliciting from a Single Source with Kratos Analytical, Chestnut Ridge, NY for the purpose of renewing a Service Contract for (1) Axis Ultra DLD X-Ray Photoelectron Spectrometer (XPS).

This is a sole source requirement inasmuch as Kratos Analytical has proprietary rights to the instrument design/schematics and XPS software utilized in the instrument. As OEM, only Kratos Analytical has access to performance verified componentry, spare parts, software, technical support, upgrades and engineering resources to maintain the original operating specifications. Furthermore, Kratos Analytical Service Engineers are the only certified and factory trained personnel available to service the instrument.

A firm fixed-price purchase order to renew the service contract will be negotiated and issued on or about 16 Aug 2024 for a 12-month performance period and include (2) 1-yr. option periods. No solicitation package will be issued. This notice is not a request for competitive quotations; however, interested parties may identify their interest and capability to respond to the requirement. The government will consider responses received by 5:00PM, EST, 16 Jul 2024. Written responses to this synopsis shall contain sufficient documentation to establish a bona fide capability to fulfill the requirement. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government.

Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. This Notice of Intent is not a Request for Quotation (RFQ) nor is it a request for competition. No telephone requests will be honored.
