Notice of Intent to Sole Source: Maintenance Services for Cedex Roche Bioanalyzer

The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b)(1), with: ROCHE DIAGNOSTICS CORPORATION, 9115 HAGUE RD, INDIANAPOLIS, IN 46256. The sole source justification is based on the following:

The Biosystems and Biomaterials Division of the National Institute of Standards & Technology (NIST) provides the measurement science, standards, technology, and data required to support the nation’s needs in the characterization of cell therapy products for the regenerative medicine field, including the measurement of metabolites in cell culture manufacturing settings. To support this mission, it utilizes a metabolite analysis system (Cedex BIO, Serial Number 36187).

NIST is now seeking on-site repair/maintenance services for the Roche Cedex Bioanalyzer (Serial Number 36187), located at NIST Gaithersburg, MD. Roche Diagnostics Corporation is the original manufacturer of the Cedex Bioanalyzer (Serial Number 36187) for which on-site repair/maintenance service is sought. After conducting thorough market research, it was determined that Roche Diagnostics Corporation is the only vendor that can meet the requirement.

As confirmed by Roche Diagnostics Corporation, the system is manufactured and maintained by Roche, and they are the only manufacturer involved. The technology is proprietary to Roche Diagnostics Corporation and was developed in house. Roche Diagnostics Corporation confirmed that they do not use or permit 3rd party vendors to perform maintenance on their equipment. Given these facts, Roche Diagnostics Corporation is the only source reasonably available to fulfill the requirement.

The resulting purchase order will be a Firm Fixed Price purchase order. The NAICS Code is 811210 - Electronic and Precision Equipment Repair and Maintenance with a size standard of $34 million. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration.

Responses received by 12:00 pm EST April 1, 2024, will be considered by the Government. Responses must be submitted via email to the Government point of contacts listed below. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
