The National Institute of Standards and Technology (NIST) Acquisition Management Division intends to negotiate a firm fixed price contract on a sole source basis with Eaton Corporation (Eaton) for the procurement of Software Support Services for the NIST Gaithersburg, MD campus. The statutory authority for this sole source acquisition is 41 U.S.C. 3304(a)(1), as implemented in Federal Acquisition Regulation Subpart 6.302-1.

The purpose of this contract is to provide Foreseer Software Support services for NIST’s Gaithersburg, MD campus. Services shall include programming, software patch updates, inspection, training and monitoring. In 2000, NIST purchased, via a competitive GSA task order, a new networked, addressable FORESEER Power monitoring system. EATON was selected as the vendor of choice to meet the competitive specifications. Technical evaluations and award recommendations were made based upon the entire scope of work.

NIST approved the Eaton system which is a wholly proprietary power monitoring system. As a result of that competition, a NIST Contracting Officer awarded Task Order GS-06F-0023R/ 1333ND21FNB190167 to Eaton Corporation (Eaton), UEI# NP3NSFVMNUM3. Through that task order, the Contractor performed Software/Hardware support for the graphic software FORESEER and device interface software Power Expert.

As a result of that award, NIST seeks continued services to maintain the proprietary FORESEER system purchased under Task Order No. GS-06F-0023R/ 1333ND21FNB190167. NIST seeks to contract with Eaton on a single source basis to provide the required follow-on software maintenance services. The Contractor shall provide all personnel, equipment, supplies, transportation, tools, materials and expertise needed to perform the required services which include:

1. Software/Hardware support.

2. Two (2) one (1) day onsite visits during the contract year.

3. Providing consultation (Field and In-Office) to the appointed Contracting Officer’s Representative (COR).

4. Travel associated with the onsite visits.

5. Perform repair.

6. Perform inspection services.

7. Provide safety-related training.

8. Provide required health hazard exposure assessments. The North American Industry Classification System (NAICS) code for this acquisition is 541511 and the size standard is $34 Million. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, all responsible sources interested may identify their interest and capability to respond to this requirement. The Government will consider responses received by established due date/time set forth in this notice.

A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for determining whether to conduct a competitive procurement in the future.
