Software Licenses for Aviators Breathing Oxygen Analyzer System

The Naval Air Warfare Center Aircraft Division Lakehurst, NJ intends to solicit and negotiate on a sole source basis with Thermo Electron North America LLC (CAGE 3WXJ7) in West Palm Beach, FL for QTY 63 software licenses P/N 734-128000 in support of the Aviators Breathing Oxygen Analyzer System to address obsolescence issues.. The Government intends to procure the above items under the statutory authority of Title 10, U.S.C.

Section 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements." Thermo Electron North America LLC is the Original Equipment Manufacturer (OEM) and all technical data related to this equipment is proprietary. This notification is not a request for competitive proposals.

However, all responses received within fifteen (15) days after the date of publication of this synopsis will be considered by the Government. A determination by the Government not to open the requirement to competition based on responses to this notice is solely within the discretion of the Government. Information received as a result of the notice of intent will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
