NUWCDIVNPT intends to purchase, on a Firm Fixed Price (FFP), the evaluation with the option to repair (3) ASE transmitters in accordance with the attached combined Solilcitation/Synopsis and Statement of Work (SOW). This solicitation requests pricing quotation for evaluations under CLINs 0001-0004. After contract award and completion of the evaluations in CLINs 0001-0004, the contractor shall provide quotations for option CLINs 0005-0007 repairs (If repair is possible).

Pricing of option CLINs 0005-0007 shall be set upon execution of the option. This requirement is being solicited on a Sole Source basis to Applied Systems Engineering (ASE), as concurred with by the Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT) Office of Small Business Programs (OSBP). The notice of intent is not a request for competitive proposals.

A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered for the purposes of determining whether to conduct a competitive requirement in the future. Summary of the rationelle to pursue a sole source procurement is as follows:

Applied Systems Engineering, Inc. (ASE) is the Original Equipment Manufacture (OEM) of the Model 327X Magnetron and Model 327Ku Magnetron transmitters. As the owner of the transmitter’s intellectual property and proprietary information, ASE is the only vendor capable of conducting an accurate evaluation of the transmitter and providing NUWCDIVNPT a valid quote for the necessary repairs. ASE is also the only vendor capable of sourcing required replacement parts and equipment and repairing the transmitters. To consider a source other than ASE, repairs would not be possible, and 3 new replacement transmitters would have to be purchased at an expected cost of $360,000 ($120,000 per unit).
