The only items in relation to this PR that must be TAA compliant are the Belkin KVMs (which is trivial, as the units in question were designed for USG use), the QNAP NAS TS-1673AU-RP RAID chassis units, and the QNAP 32GB DDR4 RAM extension modules that will be installed in the RAID chassis units. The Government intends to purchase on a brand name basis and to solicit the proposed purchase request, This action will be conducted under Federal Acquisition Regulation (FAR) Part 12 and Part 13 and this RFQ is a Total Small Business Set-Aside authority of FAR Part 52.219-6. Belkin Universal 2nd Gen. Secure KVM Switches. In the case of the secure KVM switches, these devices were developed under USG contract by Belkin for DoD and Intelligence Community use - this is a USG sanctioned monopoly.

QNAP Networked Attached Storage (NAS) RAID Servers Offerors must be registered in the System for Award Management (SAM) database prior to submission of an offer to be considered for award of any DoD contract. If 52.204-26 Section K is completed as “does not” for provision and use of the prohibited equipment and services, FAR 52.204-24 Section K would not be completed and submitted separately as part of the offer per direction within FAR 52.204-24 itself.

If FAR 52.204-26 includes “does” for either provision or use, FAR 52.204-24 Section K is required to be completed and submitted as part of the proposal. Offers must complete 52.212-3, Offeror Representations and Certifications-Commercial Items in Section K of the solicitation No terms will be incorporated into any price quote and/or order accepted by the Government unless otherwise agreed to by all parties in writing.

Any and all terms and conditions contained in any price quote and/or order that violate any Federal laws, statutes, and regulations, including but not limited to, the Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation Supplement (DFARS) are void and will have no effect.

The applicable Federal laws, statutes, and regulations, including, but not limited to, the FAR and DFARS will govern instead A determination by the Government not to compete this proposed contract based upon the responses to this notice is solely within the discretion of the government. Information received will normally be considered for the purpose of determining whether to conduct a competitive procurement. The Government will not pay for any information received.
