Revolutionary FAR Overhaul (RFO) Commercial Acquisition This is a special notice prepared in accordance with the Revolutionary FAR Overhaul (RFO) Federal Acquisition Regulation (FAR) 5.1 “Pre-solicitation Notice” for Commercial Simplified Acquisition in accordance with FAR 12.201-1(c)(2). The Naval Surface Warfare Center Carderock Division (NSWCCD) intends to award a sole source, firm-fixed-price (FFP) purchase order using Simplified Acquisition Procedures (SAP) to TA Instruments – Waters L.L.C.
(159 Lukens Dr., New Castle, DE 19720). This announcement constitutes the only notice of intent. This is not a request for competitive quotes. However, all responsible sources may submit a capability statement, which will be considered by the agency if received by the due date specified below. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.

Specification Summary The Naval Surface Warfare Center Carderock Division (NSWCCD) requires the purchase of one (1) Brand Name TA Instruments Discovery DMA 850 dynamic mechanical analyzer system.
The purchase shall include the main instrument, a standard furnace, a Gas Cooling Accessory (GCA), all required clamps and software (TRIOS), and associated accessories. The requirement also includes mandatory on-site initial installation and calibration by a manufacturer-certified representative to ensure the validity of the manufacturer's warranty, as well as basic operational training for up to four (4) government personnel.
The DMA 850 is required for its specific, patented technology and for its direct compatibility with existing laboratory equipment, software, and historical data at NSWCCD. II. Minimum Specifications and PWS The Performance Work Statement (PWS) and the redacted Sole Source Justification will be attached to this notice on SAM.gov. III.
Submission of Capability Statements Interested firms who believe they can provide an instrument that fully meets the Government's requirement as a direct replacement for the brand-name item specified may submit a capability statement. Capability statements must demonstrate the vendor's ability to provide a system that is fully compatible with existing accessories and software (TA Instruments TRIOS) and can produce identical, interchangeable data with the Government's existing TA Instruments equipment.
Capability statements are due by 01-SEP-26 at 12:00 noon EST. All submissions must be sent electronically to Michael S. Brodie at michael.s.brodie7.civ@us.navy.mil and must include:
Official Company Name; Point of Contact (Name, Phone, and Email); CAGE Code and Unique Entity ID (UEI); and Technical documentation demonstrating the capability to meet the exact attached PWS specifications, including the compatibility requirements. IV. Applicable Clauses and Provisions Applicable clauses and provisions included in FAR 12.205, DFARS 212.301, and NMCARS 5212.3 are incorporated into this notice.

FOB Evaluation Criteria (Ref: M-247-H001) Quotes submitted on an f.o.b. basis other than that specified in the solicitation shall be rejected as unacceptable.
