The Naval Air Systems Command (NAVAIR) intends to add scope to an existing Delivery Order N00019-21-F-0804 under the Raytheon Corporate Basic Ordering Agreement N00019-20-G-0007 on a sole source basis to Raytheon. This is the continuing required effort to repair Weapons Replaceable Assemblies (WRAs) identified as nonfunctioning following baseline testing during the Engineering Change Proposal (ECP) 6279 upgrades done by the Original Equipment Manufacturer (OEM). Effort also to include Configuration upgrades.
The Government intends to solicit and negotiate with only one source under the authority of 10 U.S.C. 2304(c)(1) and FAR 6.302-1, "Only One Responsible Source and No Other Type of Supplies or Services will Satisfy Agency Requirements." Raytheon is the designer, developer, manufacturer, and Depot for the APG-79 radar. They are the sole owner of drawings required to repair APG-79 equipment.
Repairs are required prior to equipment modification through ECP 6279. Therefore, Raytheon Company is the only contractor with the requisite knowledge, experience, and technical data that can meet the Government's requirements on a timely basis and in a cost-effective manner.
The Government has deemed the requirements listed above for the continued development or production of a major system, or highly specialized equipment, including major components thereof, to be available only through the original source, and has determined that award to any other source would result in a substantial duplication of cost to the Government that is not expected to be recovered through competition. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS.
No contract will be awarded on the basis of offers received in response to this notice. All inquiries and concerns must be addressed to the Contract Specialist, John J.
