This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 - Synopses of Proposed Contract Actions U.S. Army Corps of Engineers - Omaha District, intends to issue a Firm-Fixed Price contract to Crow Creek Sioux Tribe of Omaha Nebraska, 100 Drifting Goose Road, Fort Thompson, South Dakota 57339-0470. The purpose of this acquisition is for a non-personnel non severable service contract to provide archaeological services to include:

cultural resource site assessment of lands currently owned by the U.S. Army Corps of Engineers that are within and adjacent to the exterior boundaries of Crow Creek Reservation in South Dakota. The purpose of site monitoring is to identify all impacts affecting cultural resource site integrity.

The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 13.106-1(b) Soliciting from a single source (1) for purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action.

The NAICS code is 921150, American Indian and Alaska Native Tribal Governments. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. If no affirmative written responses are received by 2 pm CDT on 30 April 2024, an award will be made without further notice. Oral communications are not acceptable in response to this notice.

A determination by the government not to compete this proposed requirement is solely within the discretion of the government. Responses and question shall be submitted to tina.l.keimig@usace.army.mil. The U.S. Army Corps of Engineers is not responsible for any costs incurred by responding to this notice.
