This is a notice of intent to award a sole source contract and is not a request for quotes. The Department of Veterans Affairs, St. Cloud VA Health Care Systems intends to negotiate a Firm Fixed Price (FFP) sole source award to Beacon Point Associates, LLC., a Service-Disabled Veteran Owned Small Business (SDVOSB), for the procurement of Genesis Sterilization Containers for the Sterilization Processing Service, within the Veterans Health Administration (VHA).

Beacon Point will provide V. Mueller/Steris manufactured Genesis containers and the single-use disposable filters for this brand. These containers protect surgical equipment once it has been sterilized. The Genesis brand is compatible with Steris Pro V Maxx sterilization systems already in use at the St. Cloud VA. The Genesis brand is required for interchangeability.

These sterilization containers are not compatible with other brands as the container size have slightly different dimensions and the lids must fit and lock accordingly for proper sterilization. The Genesis brand supplies the color-coded lids that provide identifiers for the service line and their specific equipment. The filtration system in these containers do not allow for any other containers to be used or replace for parts.

Because these are additions to the existing containers, the same brand will allow equipment management and lessen risk to patient and staff safety for compliance with single Manufacturer Instructions For Use (IFU)s and cleaning procedures. The applicable North American Industry Classification System (NAICS) code 339113 Surgical Appliance and Supplies Manufacturing is most appropriate for this requirement. The size standard is:

800 people. The Product Service Code (PSC) is 6515 Medical Equipment and Accessories and Supplies. In accordance with VAAR 819.7008, the determination to make a sole source award to an SDVOSB is a business decision wholly within the discretion of the Contracting officer; therefore, the requirement to ensure that offers are solicited from as many potential sources as practicable is not applicable to this procurement. This is not a request for proposals.

The Government is not responsible for any costs associated with responding to this notice. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR 819.7009 (DEVIATION) up to $5,000,000. Check the specific VAAR clause used below:
