NOTICE OF INTENT TO SOLE SOURCE Â The Department of Veterans Affairs (VA), Veterans Health Administration (VHA), Network Contracting Office (NCO) 17, intends to award a firm-fixed-price contract on a sole source basis to:

BECKMAN COULTER, INC Â 250 S KRAEMER BLVD Â BREA, CA 92821 Â The contractor shall provide service coverage for all medical devices listed under the Equipment Listing in accordance with Department of Veterans Affairs (VA) and Original Equipment Manufacturer (OEM) specifications. Services to be performed include, but are not limited to, repairs, preventative maintenance (PM), calibrations, defective part replacement, and other support services required to maintain equipment performance and safety.

All covered medical devices are located within the Veterans Affairs North Texas Health Care System (VANTHCS), with the main campus address: Veterans Affairs North Texas Health Care System (VANTHCS)  4500 S Lancaster Rd  Dallas, TX 75216  Equipment Listing: U481-10 CHEMISTRY ANALYZER AU480 Serial number 2019072822 All work must be performed by OEM trained and certified engineers or technicians, in full compliance with applicable manufacturer specifications, codes, and standards.

Maintenance and repairs, when applicable, shall be performed in accordance with OEM specifications. All replacement parts shall be certified new and sourced from the original manufacturer; the contractor shall avoid the use of refurbished and non-OEM parts. VANTHCS recognizes that equipment may be subject to inspection prior to the commencement of a service agreement to ensure the good working order of equipment detailed herein.

Any such inspection is intended solely to gather information concerning necessary repairs or adjustments (if applicable) after an agreement has been reached. The inspection shall not conclude with a determination that a PM is required prior to entering into an agreement, nor shall it be used to deem equipment to be in good working order as a condition precedent to award. Once an agreement has been made, additional inspections and tests shall be performed as needed or upon request of the Government.

The contractor shall provide all labor, transportation, expertise, tools, test equipment, and materials necessary to perform the specified services in accordance with VA and OEM guidance and specifications. The anticipated statutory authority for this sole source procurement is 41 U.S.C. 3304(a)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

This authority is being used because Beckman Coulter, Inc. is the only known responsible source capable of providing the required OEM-certified support, parts, and services necessary to ensure compatibility, safety, and compliance with OEM specifications for the covered devices. This notice is not a request for quotations or proposals. A contract will not be awarded based on any offer received in response to this notice.

However, all responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. Any responses received will be used to determine whether a comparable source is available and more advantageous to the Government. If no affirmative written response is received within ten (10) calendar days from the date of publication of this notice, a contract will be issued to Beckman Coulter, Inc. without further notice.
